Who provides the service
The service provider is the administrator of the nowhosted.com service. Contact [email protected] for account, billing, service, or legal questions. If you act for a business or another organization, you confirm that you have authority to accept these terms for it. You must have legal capacity to enter into this agreement.
Your selected plan describes the capacity, features, support, and billing period included in your subscription. A separately agreed data processing agreement governs processing of personal data that you host on behalf of your organization. If that agreement conflicts with these terms on its specific data protection subject matter, that agreement controls for that subject matter. Mandatory legal rights continue to apply.
Keep account access accurate and secure
Provide an accurate work email and complete the account confirmation process. Keep contact and billing details current so you receive account, renewal, and security communications. Protect your password and confirmation codes, manage the people you authorize to use the account, and notify us promptly of suspected unauthorized access.
You are responsible for activity you authorize and for permissions granted to your team or clients. You must not access another account without permission or circumvent access restrictions. We can request information reasonably necessary to verify account ownership before making sensitive changes or releasing an export.
Choose monthly or yearly billing
Hosting is a paid subscription. Plans renew automatically at the end of each monthly or yearly billing period until cancelled. By subscribing, you authorize recurring charges using the billing arrangement you select. Yearly billing saves 50 percent compared with monthly billing, and the annual amount is charged for the yearly period. Review current prices and inclusions in the WordPress hosting plans before subscribing.
Card billing is available on every plan. Scale also supports invoice billing and purchase orders, with any agreed invoice payment terms forming part of that billing arrangement. A purchase order does not replace these service terms unless we expressly agree to its different terms. You are responsible for payment of the subscription and any applicable taxes disclosed as part of the purchase.
We communicate a change to renewal pricing before it applies and provide an opportunity to cancel before the affected renewal. We do not apply a renewal price change retroactively to a paid period. Failed or overdue payments can result in suspension after notice and an opportunity to resolve the issue, except where immediate action is justified under the suspension provisions below.
Use capacity that fits your sites
Site counts, storage, supported applications, and support levels depend on the selected plan. Monthly visit allowances are soft limits. There are no visit overage fees; when traffic exceeds the allowance, we suggest a plan upgrade. A soft visit limit does not authorize activity that threatens service security or stability or breaches acceptable use.
You can change plans as your needs change. Contact [email protected] to confirm the effective date and billing treatment for the change before proceeding. We do not promise a particular proration or refund arrangement unless it is disclosed and agreed. Review managed hosting to understand the hosting service alongside the application work you control.
Operate lawful sites and applications
You must have the rights and permissions needed for the content, software, domains, and personal data you host. Comply with applicable law and respect other people's intellectual property and privacy. You are responsible for the activity and content of sites you manage for clients.
- Do not host or distribute malware or use the service to compromise other systems.
- Do not send spam or facilitate unsolicited bulk messaging.
- Do not host illegal content or use the service for unlawful activity.
- Do not use the service for crypto mining.
- Do not operate open proxies or relay services that allow uncontrolled third-party traffic.
- Do not bypass account controls, probe systems without authorization, or interfere with other sites or infrastructure.
We can investigate credible reports of abuse and take proportionate steps to protect the service. Email [email protected] to report a concern with enough detail to identify the affected site and activity.
Your content remains yours
You retain ownership of your content, databases, application code, and other materials you upload. You grant us the limited permission needed to store, copy, transmit, back up, and otherwise process that material to provide and protect the service and carry out your instructions. Our service providers can perform those activities only as needed for their role. This permission does not transfer ownership of your materials.
You remain responsible for content accuracy, lawful collection of personal data, software licenses, application behavior, and the permissions granted within your applications. Hosting support does not transfer responsibility for your business decisions or the legal compliance of your content. You retain the right to export a full backup at any time.
Keep recovery copies under your control
Backups are a service aid. Business includes daily backups kept for 14 days, Agency for 30 days, and Scale for 90 days. Scale also includes hourly backups for WooCommerce. The service includes one-click restore. Keep your own independent copies of important files and databases, and check that your recovery arrangements meet your business needs.
A restore returns data to the selected recovery point and can replace changes made since that point. Review recent orders, submissions, and other updates before authorizing a restore. Backup retention is limited to the plan and does not provide indefinite archival storage. Review the WordPress hosting platform for backup and staging features.
Review your site during the move
Free white-glove migration with zero downtime is included on every plan. The process uses a staging copy, testing, and DNS cutover with low TTL. You provide the access and authorizations needed for the move and participate in checking that the copied site behaves as expected. Read the website migration process to prepare the handover.
Identify custom code, integrations, and business tasks that need testing. Report migration issues promptly with the site URL and a description of what happens so we can investigate. You control cancellation of your previous hosting subscription and remain responsible for its charges and export requirements. Retain your own copy of the source site while reviewing the move.
Apply the commitments in your plan
Business includes email support, Agency includes priority support, and Scale includes 24/7 priority support with a 15-minute first response. A first response is the initial reply and does not guarantee resolution within that time. Resolution depends on the issue, the information available, and any action required from you or another service.
No plan includes an uptime guarantee or service credits. Every plan includes uptime monitoring every minute, and Scale also includes a named on-call contact. Contact [email protected] for availability or support questions. This clause does not restrict remedies that mandatory law provides.
End renewal and take your data with you
You can cancel at any time by emailing [email protected] from your account email. Cancellation stops future renewal, and access continues until the end of the paid period unless suspension or termination under these terms applies. Cancellation does not by itself create a refund for the remaining paid period. Any refund required by applicable law or separately agreed terms still applies.
There is no lock-in. You can export a full backup at any time while account access is active. Arrange the export before the paid period ends and check that it contains the material you need. Continued hosting, account access, or data retention after the paid period is not included. If access is suspended, contact support about an export; any assistance remains subject to lawful restrictions and the security reason for the suspension.
After service ends, we delete hosted data through the applicable operational and backup cycles, subject to legal retention duties and any applicable data processing agreement. We do not promise indefinite recovery after closure. Personal data in account and billing records is handled under the privacy policy and applicable law.
Protect the service when problems arise
We can restrict or suspend affected service for unpaid charges, material breaches of these terms, unauthorized access, credible security threats, or a binding legal requirement. Where practical and lawful, we notify you of the reason and provide an opportunity to resolve the issue. We can act immediately when delay risks harm, compromises security, or breaches a legal obligation.
We can terminate service if a material breach remains unresolved after a reasonable opportunity to correct it, or if the breach is serious enough to justify immediate termination. Where we discontinue service for reasons unrelated to your breach, we provide reasonable notice and refund prepaid fees attributable to the unused service period. We facilitate export where lawful and technically feasible. Termination does not remove payment obligations already incurred or either party's rights concerning earlier breaches.
Understand the limits of the service
We provide the service with reasonable care and skill and the express commitments in your plan. You remain responsible for your applications, lawful content, authorized users, and independent recovery copies. To the extent permitted by law, we exclude implied warranties beyond the express commitments in this agreement and do not guarantee that the service is error-free or immune from every security threat.
To the extent permitted by law, neither party is liable to the other for indirect or consequential losses, including lost profit or lost business opportunity. Our aggregate liability arising from the affected service is limited to the fees you paid for that service for the paid subscription period in which the event giving rise to the claim occurs. This limitation does not reduce a refund or service credit expressly due under the agreement.
These exclusions and limits do not apply to fraud, willful misconduct, gross negligence where it cannot lawfully be limited, death or personal injury caused by negligence where applicable, or any liability that applicable law prohibits limiting. Mandatory privacy, consumer, and other statutory rights remain effective. You must take reasonable steps to reduce avoidable losses, including preserving independent copies of important data.
Review notices that affect your subscription
We can update these terms as the service or legal requirements change. We publish the revised version with its update date and notify account holders before material changes apply, except where urgent legal or security requirements require faster action. Where applicable law requires consent, we obtain it. Changes do not remove rights or claims that arise before the change takes effect.
If you do not accept a material change, you can cancel before it takes effect. We explain any effect on an existing paid period in the change notice and honor mandatory rights and any refund required by law. Questions, cancellation requests, and notices under these terms go to [email protected].
